Thanks to a nice guy I found, I was able to obtain the electronic copy of the M17xR3 manual.
In this manual it states that the previously stated laptop was compatable with Sata 6.0Gbps aka SATA 3.
Dell has tried to scrub the site, and the net of this information, because they know that they have a defective product out there, and if more users who get a hold of this information, they will be forced to do something about it, instead of stealing from those who paid for Sata 3 only to have it downclocked to Sata 2.
I will be posting a link to the file here shortly, is there a proper way to host a file? Or can it be any link site?

We all know about this. Just flash your bios to A08, not sure if it has to be modded or not, you will gain the SATA III speeds on one of the HDD slots.

Dell removed SATA3 support in newer BIOS because most systems can not run reliably at 6Gbps. If A08 works for you then great. Some of us were able to get a replacement because we had some pull with Dell sales. In my case my company buys Dell servers and I was holding my M18xR2 order until they resolved my complaint. If you don't have any real $ to dangle in front of them, I'm not sure you'll get very far in getting a replacement.
This is understandable since the defect is so minor they are only offering an accessory as compensation.

I'm in agreement with Trooper. Dell advertised and sold the R3 with a certain set of specifications that a lot of tech geeks drooled over and then, when they figured out they couldn't make it work like they'd advertised.........they changed the spec sheet, did all they could to remove all traces of the old spec sheets, and told the tech geeks to suck it up rather than doing the right thing and fix the problem or make it right.

BTW that manual (Rev. A00) only applies to R3's sold before January of 2012. If you bought your after that, Rev A01 is the correct manual.

it's unfixable. i got lucky and got replacement for my R3 > R4.
But only if you bought it in 2011 you might get lucky.. -

I've complained about it at Dell management, but they don't care. They told me basically my complaint was useless because the manual states:

Like that would hold in court. Dell after sales sucks and so does their repair service. -
