    Dell/Alienware Warranty = Refurb or new machine?

    I thought it could be interesting to hear what people think about Dell/Alienware offering people a refurb or a used machine if your machine breaks down within warranty period and Dell/Alienware have tried to fix the machine more than 3 times without success. I hope that this thread will be able to give us an idea how often this happens as I have seen several people on this forum having this problem. My hope is that people with this issue will be able to get a more clear picture of what to do and what the outcome may be if taking their cases to BBB.

    1. Is it acceptable to offer a refurb or used machine for a customer when your current machine breaks down within warranty?

    2. Do you find this to be legally acceptable in the States(US) or Canada?

    3. If not did you take your case to BBB and did you win the case?


    If this thread should violate the forum rules and terms I apologize and I understand that the thread will be removed. I have only started this thread in order to help people on this forum with the issue described above.

    well i got a referb unit shipped to me , referb was doa. i contacted the person incharge of my case and he ordered me a brand new r2 replacement.

    This one is going to cause alot of bad feeling. :eek:
    1st - If system is past a certain age same would be refurb, if you have accident with car they don't replace with new. They replace parts or give you value of item at its age right.
    So as in Dells case unit under 21 days same as new or better. Past 21 days repair or rebuilt. In a nut shell! :D

    2nd Under above terms yes.

    3rd No, But if you feel treated unfairly yes of course!

    I am a little skeptical about the part with an accident and a car. I mean if the machine(laptop) breaks down it is hardly because of careless driving or that you have been hit by another run-away-laptop :p A machine is suppose to work a certain amount of time when bought from new, and therefore the warranty on one year as stated in many nations must be their in order to make sure that the machine is build well enough to last that time out right? If the machine breaks and they are not up to the task at repairing it after three strikes I still believe that the the basic warranty should give them a new laptop or a refund right? Also when I read these links it seems like this law firm including the Magnuson–Moss Warranty Act clearly disagree with your first claim. It clearly states that if within warranty and the firm has failed to repair an issue then a new machine or a refund has to be offered. Where did you read the information that you use in your answer to the first question?

    Same here, I got a refurb, DOA, Unfortunitly, my wife just lost my new phone(samsung caliber) :mad:. So all I can do now is contact them via email which I have already done! That is why I am waiting, I have no choice. :(

    I agree with you on that to a point. The difference seems to be the 3 strikes and there I agree with you. Cannt fix it in 3 tries replace or refund. But where we all are not agreeing is the replace with?
    Dell is saying over 21 days used for refurb (needs to be same or better) seems they fall short sometimes and not up to standards that should be. Thats a different issue. They have set a guideline under 21days (could of been 90 or 120 they picked 21 ) new same or if not available then better.
    I can understand their needing to have a guideline, and the info is on their site under their warranty conditions which eveyone agrees to when you purchase. If I am wrong I apologize, it's the way I read it.
