ok. I'm quite new to ATI on the M17x. I ran the Crysis benchmark and got 28FPS average. 3dmark06 at 2.93 is 16k, and vantage is 11k. I checked with GPU-z and it says 2gpu enabled. When I run Crysis, BC 2, AVP with crossfireX on and disabled, I get the exact same FPS in the game. I'm using 10.3preview. i've also installed the 10.3 ATI profiles. on AVP i have everything maxed out. I'm getting 30FPS average and when I throw out a flare, FPS drops to 20. my other M17x with crossfire had the same issue. clearly this isn't a hardware issue but driver issue?

Your setup is fine, it's the game itself. If you run it maxed out the FPS of 28 average is pretty much your max average without OC'ing the GPUs. I don't get anywhere near 28 with a 520M.
I suggest you to look into M17X benchmarking and OC'ing threads for additional tips.
