    For me it's not similar & this is unfair case. Apple acting like they invented the apple tree.

    its an IT school thats been around since 2001. Mixed feelings about it.

    The apples do look alike, the leaf is on the same side even and the same shape. And also Apple HAS to defend it's trade mark or they will lose it. So even if Apple doesn't care they have to take action. The fact that it is a logo for a technology school probably makes the problem worse. As some one may think it is a school sponsored by Apple.

    I believe they only had the logo since 2005.

    I find it odd that there is a TM beside the VSBT logo, if it's TM'd how could Apple even do anything?

    But something to think of if Apple has TM'd the Apple as a logo other company's can't use it. Even if it doesn't look like Apple's logo it's still a Apple.

    They might start suing people for eating apples next time around. "People are Humiliating our Branded logo by eating Apples, that is totally unacceptable" as Steve "side burns" Jobs would say. duh

    Lately Apple has gone a long way in gaining a bad reputation for being a company that wants to control everything. I seem to remember a lot of people bashing Microsoft for the same behavior right before they were hauled into court. I think Apple is headed in the same direction.

    It looks as if the power is going to their heads.

    As far as the Apples, I do not think they are similar enough that Apple would win in court, but the fact is that Apple has enough money to drag it out until the school has no choice but to drop the suit because they can't afford it.

    I think this is more of a bullying case. Apple should "know when to fold them." If this get pulled into court can you imagine the way the MEdia Giants would spin this. LMAO. Since we all know how well they spin current events these days.

    Anyone can register a trademark. There is no check that the trademark is valid when you register it. Apple is within their rights to challenge the trademark here because the design has clear similarities to the Apple logo (relative dimensions of the apple and leaf, and the size, shape, and placement of the the leaf in both designs) and because the later registration is in a related field to Apple: Apple also offers computer training, and the VSBT web site includes the Mac OS logo, the Adobe logo, and other technology-related logos.

    That said, there is no guarantee that Apple will win. The differences between the logos are significant, although Apple will argue (correctly, I think) that the logo is a cynical attempt to generate publicity by echoing the Apple logo. But it was Apple who took their inspiration from another Apple Corp. and repeatedly agreed not to use the Apple logo to market music, eventually winning that battle on their third attempt. It's a complicated area of the law, and the outcome is not clear if VBST has the money to stay in the fight long enough to force a decision.

    This might sound shallow, but why couldn't they just write a letter to the school? I mean, seriously, sueing a school? That's pathetic, and will probably leave several hundred students without a school... I mean, come on, even if they gain a few billion(which they won't), they'll be loosing loads... they'll never be able to gain enough money to compensate the amount of people who won't buy from them now.

    I don't think they should pursue this particular one. I see the misuse of the Apple logo even more evidently in some other companies and stores.

    But while we're at it, people shouldn't forget about MikeRoweSoft :D.

    now grocery stores have to stop selling apples or steve will sue them.

    this is a total crock. if it were a computer company with the logo, then yeah I can see it but its a school, not in any direct competiton of apple or their computers, and its only similar as its an apple not in look or anything...

    unreal !!! and I just jumped over to this forum to consider buying a MBP, now that I've read this the hell with Apple ... that's too much ....

    didn't take me long to jump ship :) ... I knew they where arrogant, and expensive, and overrated... ah, it's a good enough excuse jump back to normalcy ... hello Vista ;)

    That's a little surprising, I didn't think a lawsuit would be enough to turn away a customer...isn't it more about the product than the corporate actions? Because Microsoft isn't much better, if not worse in that regard...

    if i was going to start a tech school today, what would be my motive for choosing an apple as a logo?...

    is it just my creative brilliance that an apple is a cool logo?

    i'm not sold that apple is evil for attacking a "school" for this. private schools are businesses too and they aren't exempt from rules.

    And I agree with those who say that while the company shouldn't necessarily be sued, its obvious the apple in their logo is trying to portray some sort of relation with Apple, which is among the most recognized and highly ranked brands right now. Its like the companies who market with "i" in their product. Sure, its not always because of Apple but it definitely makes it a bit cooler, or so they hope.
