Xirurg, man, please don't go over the top and say Apple made the first proper touchscreen phone. Far too often do I hear how the iPhone is "innovative"... it features interesting solutions, but... before it existed, and still do exist better touchscreen phones and people that have "invented" (bad word to use, since it was a natural course for phones) that kind of device long before Apple did.

Also, fairness doesn't have much to do here - patents are patents, and that's the law.

There were other touch screen phones that existed before the iPhone. Apple may get a lot of hype for their products but they were never the first to the market or invested it first.

Apple is the first company which assembled all these multitouch gestures onto a single phone and made sure it's ergonomic and well designed before putting it on the market.

I think Apple did a great job on marketing the iPhone, iPod Touch, etc. with a touch screen. It's a great feeling touch screen, and Apple did the best job on letting the public know about it. :)

i am not seeing how i am being judgmental here; its fine to have supporters, but is it not fine to have people having fun when apple has to give credit where credit is due?(if the court rule in favor of elan, that is)

what kind of logic is this? buy american? or finding WMD in iraq?
