djembe,
I just wanted to let you know that a customer pointed this out to me today.....
http://store.yahoo.com/directron/z71v.html
Go down and look at the link that says "notebookreview.com review"
Just incase you didn't submit that to them or you ARE them.... I wanted to make you aware of that. If for some reason you are Directron, that's certainly something that should be disclosed... But I'm guessing they just found your review.

Oh, wierd!
No, I have no affiliation whatsoever to them. It looks like they just linked to my review here.
FYI: I'm a Seminary student and a custodian. I have never even considered selling computers (unless you want to add me to the ProPortable staff and show me how it works!)

Lol.. if you want to, just drop me a line, I'll hook you up.
Someone from Australia just called and said they were reading that review.... so I figured it'd be nice to show you.... you might want to drop them a line. You might think it's cool for them to do that, but they're using your hard work to sell their computers without your consent.... but it was deffinately a link to your particular review and not a general review or one done by notebook review. -
I might actually be interested if I didn't live so far away... but such as it is, I can't
Since I was compensated for my review here, I'll have to check with Andrew to see if I still have "rights" to it, or if he essentially bought the rights along with the review.
Thanks for letting me know! I appreciate it! -
PROPortable Company Representative
Humm... well Andrew would probably like to know because they shouldn't be linking to their reviews without asked first.

Edit: To qualify:
Had they systematically linked to reviews of other systems and claimed them as thei own content it would be illigal in some countries. Had they linked to a 'Porportable' (or whatever system builder) as may be the accurate reperesentation when you're buying an 'Built on Asus' system it might be misleading, if not illegal. Here they are linking a review beeing represented as an Asus Z71V review and they're giving full credit. How on earth is that a problem. All courts that have dealt with the subject matter, also in the US, have found that hyperlinking is 'a part of the medium' as long as no misrepresentation of content, or the origin said of content is taking place.
The moment you have to ask to link someone the WWW die. -

I'm pretty sick of you asking dumb questions of things I say. No, I'm not kidding. They're using a review from this site to sell their products. I asked djembe if he had gave them permission and he surely did not...... if he thinks it has become property of the site, then it's the admins job to issue that approval.
You'll see. -
Read the edit. Linking positive reviews is someone everyone will do. It's not deceptive in any way.
I'll quit disagreeing with you whan you quit beeing silly. If you still think I'm out to get you or something you think to highly of yourself. I agree with you on most of the 200 post you have each day, but reserve the right to disagree when you're: So to speak... Out there. -

Personally, I don't care about this... I just wanted to bring it to his attention because either he had a lot of explaining to do, or he might like to know someone else is using this.
However, it's copyright infringement no matter how you put it if they didn't get permission to link to it for the purpose that they did... I don't care how many people do it. I'm not talking about written consent even... just somebody's words shouldn't be used by anyone else without getting a simple, it's ok to use it.
I don't think you're out to get me, I think sometimes you don't have anything better to do then make a comment where a comment isn't needed. If I made the comment to you.. say you did this review and I said all this to you... if you responded and just said "surely you're kidding?" .. I might understand that. But apparently djembe liked that I notified him and that's really all that matters. Don't worry.. I don't think THAT highly of myself and I enjoy most of the stuff you bring up. But surely you can see where I'm coming from. If you want to have a field day, you could comment on my grammer after every post, that could help fill up some space -
As for the rest: Noise. -

You're a real piece of work. Can't "link" to anything you want, that's going to score them higher in google, will it not? I mean look at the people who viewed that page to begin with.
-
I'd think Proportable is a great company to buy Asus products from.
Sue me.
What the hell: I'll edit this one too. Say you think it's an unreasonable buisness practice, and I'll agree with you (because the linked review does not reflect a 'ThinkBox.com Z71v'). But keep up this 'illegal' nonsense and you're only making a fool of yourself. Becuase it's not, and I really don't think you are. -
Please let's not get out of hand with this. Linking to other sites is certainly legal, all public pages are open for such activity. Justin is just concerned that the reseller is trying to deceive. I think it's a little shady that they listed us under references, but their practice is not illegal. That said, I don't think I'd buy from them, their contact form doesn't work.
-
Thanks for the perspective. I wouldn't have become a customer of theirs either and I mostly think that everyone agrees. Absolutes just tend to rub me the wrong way sometimes.
Sorry for any bad vibes. -
PROPortable Company Representative
Haha...... if I threaten to sue, will you go all over the web and link to me? Promise?
Besides the initial honor of finding out some site linked to something you did....... how would you feel to have done the work and then have someone else use your work to sell their products? IF you were a professional reviewer and your work was officially published for a site or for a magazine.... you're getting paid for that and then it's up to your employer to decide whether it's ok to use that information. Often, I think actually linking to the site could be made illegal though in certain circumstances without written consent. We had a company who should remain nameless who not only ripped off images of ours, but the link to them were still linked directly to our servers....... That may be slightly different than a straight link, but it's using our intellectual property to make them money........
It's kind of like making an illegal copy of software... .that's not really illegal to make yourself a copy of your own software for backup... but if you go and try to sell that, expect your world to come crashing down...
That's enough though... I think we've both given that place more free advertising than needed. -
Andrew said that it was "sort of okay" and that he couldn't stop them from linking to Notebook Review, whereas if they had actually taken part of the review and posted it on their site, Andrew could ask them to remove it.
Thanks again for the heads up, Justin. You're tops in my book! -
Meh... Let it go. It's really nothing like that.
Linking to independent reviews is something that should be encouraged with resellers and retailers. In this case it could actually have been debatable because these notebooks are not actually 'Asus products', but that's not how the review is presented. Even a direct quote taken out of context is not illegal and this was only a reference: 'Notebookreview.com Review'. No claim of ownership of the material, no misrepresentation, no claim of endorsement. No harm. No foul.
Hell, I used to have a sticker on an asus retail laptop saying stuff like: "Best Laptop of the Year -Toms Hardware Guide" in reference to a completely different product. I have an Asus retail GFX box with the same kind of 'misleading' statements. In fact, reviewsites live and die by pople linking them.
OK?

Nice to see everyone getting along and great to see it not degenerate into a personal flame war.
Thanks for making my job easy!

The problem with online arguments is that there is no way to gauge someone's tone or mood or anything like that. So it may seem like someone is stepping on your toes when they are in fact just simply stating their opinion too. Online arguing is futile. Not only will you most likely never meet the other person, you will never know if they are really even arguing with the same intensity about the same thing you are arguing about.
That being said, it is amusing to the rest of us. -

" STORM IN A TEACUP "
Notebookreview.com has received free and wellcome publicity,
Asus z71v has received good reviews and possibly increased sales,
djembe has become more famous because of the publicity.
So , may Iknow who has any axe to grind about this whole issue ?? :asus: -
Can't we all just get along...........until we have to break out the nightsticks and tazer guns and go at each other
That could be really entertaining

We should all say thank you to directron. If they did something wrong here....They just sent people to this forum and customers to any resellers posting here. Not to smart on their part but hey i dont mind. If they had copied the review and pasted it on their site thats illegal.
