I bought a 9-cell battery for my M5 a few weeks ago from an eBay seller.

I got the battery last week, and it looking at the battery it looks nothing like the 9-cell. Part number indicates a 6-cell (A32-M5), but again the battery looks nothing like the 6-cell and looks exactly like my 3-cell. Heck, it even weights roughly the same. Shouldn't the 6-cell stick out of the machine?
I tried contacting the seller about 4 days ago, no reply. They say reply in 5 days from an auto response, but last time when I asked him about shipping it was almost immediate.
I got scammed?

What's the battery capacity reported as? Use a program like NHC, Battery Eater Pro or MobileMeter to check.
What's it say on the label exactly? Your pics are too blurry to make out. -
Was it covered under ebay/paypall's buyer protection program? If the part number says 6cell, regardless of what it actually is, including some kind of magical 9 cell stuck into a 3 cell case, you can report it to ebay. :-\

I did try plugging it, but it just gives me rubbish data, e.g. charged capacity way higher than design capacity. Didn't want to charge it up completely since I don't want the guy to challenge me for using it even if I know it's the wrong item, in case he does come back to me.

Strange thing is, label on mine is black and the one is silver...
On the side, there's another part number that says 70-N98V1B1000, S5L52311-43401BB010 T, orange and mine has an exact same sticker. -
Well if the label on it is accurate then you definitely didn't get the 9-cell. It's the 6-cell with 48Wh capacity (11.1V x 4.4Ah = 48.84Wh). The colour of the label shouldn't be anything of concern, from what I can make out from your picture the label looks similar to the label on my Z70Va battery.
It could just be a packing/shipping mix-up, so i'd try e-mailing again with more details and waiting a few more days. -

I'm still skeptical that if this battery is even the 6-cell. As far as I remember the 6-cell should stick out of the machine, and this one doesn't. -

Let me first tell you that you bought it on ebay and considering the small group of Asus owners out there and even smaller community that sell their products...... you shouldn't have expected much.
.. That's a 3 battery if I've ever seen one and if you want to sit back and try to justify that it just might be, you're in denial....... Even the 6 cell sticks out of the machine 3/4" and not to say it's fake..... but it looks like someone is trying to make some money off ebay buy selling to unknowning consumers.... If I were to do that, I'd probably sell to a community that doesn't know anything about computers and is a lot larger.... like those with Dells..
.... by the way, thanks for including pictures for comparion..... they're all out of focus and the ones where you zoom in to take shots of labels with words on them can't be seen...... so it is almost a waste to have even taken them, but from what I can see and what I know about Asus' batteries....... unless this company took a 3 cell battery apart and filled it back up with more cells that were smaller...... it's impossible to have a 6 cell. Personally, if that's what I did, I'd also sell it for a heck of a lot more also... -
It doesn't look like you got what you paid for. I'd file a claim with Paypal as soon as you can. The seller will be forced to take action on the claim that you have placed. And if he doesn't within 10 days you will get a 100% refund. It also looks like the seller has a 30 day return policy. But if he does not respond what good is that policy?
