Okay, well I had a Studio XPS 1640 which throttled. After a lot of hassle, I got it replaced, but they never asked me to send the old one back, or even discussed it.
Now, 3 months later I've still got my old laptop (which is worth at least £600) sitting around and I'm not using it. So, here's the question: can i sell it? I'm reasonably well off, so it isn't essential that I get rid of it, and therefore I'll only sell it if I'm 100% sure I'm allowed to. It does seem a shame to let it sit around doing nothing though, and the money would be a nice treat.
So, any ideas?

No. Call Dell and let them know it hasnt been sent back. If they say keep it then fine.

The replacement is issued on the grounds that they recover the old system. They have forgotten to do so, but it is in the terms of the replacement that the old one is returned.
So, you can sell it, but they may come to you at a later date to ask for the system and charge you accordingly (for the replacement system) if you cannot return it.
The moment you accept the replacement, the original system is Dell's property again (this is how Dell sees it).
As jkyle said - contact them and see what they say.
If they say you can keep it make sure you get a copy of that in writing (e.g. by email) as an agreement on the phone can't really be proved if they ask you to return it later on. -
I was told by my replacement 'agent' that once I had received my new machine, to contact them and they will arrange for a courier to pick it up, she also mentioned I had 14 days to get it back to them otherwise I would be charged for it.
I'd call them also - as much as I'm sure you don't want to! -
You should return that laptop to Dell. They gave you a replacement, under the terms that the defective one would be returned to them.
What you need to do (and it's the right thing to do), is contact Dell and ask them how they would like their defective laptop returned to them.
If they advise that they do not want it returned to them, then ask for something in writing that you are allowed to keep it and do with what you want.
I really don't think they have forgotten you have the lappy, I think something probably went amiss at Dell (like that never happens). And, eventually it will all catchup & they will be contacting you.
In the US once you receive a replacement you have 10 days to return the defective unit to Dell. If you don't return it w/in that timely manner you can expect to receive phone calls, e-mails & a letter from their 3rd Party Contract "OnProcess" to help you return the Unit.
Also, they can/will suspend all warranties, including your Accidental Coverage, until that defective unit is returned to Dell (at least here in the US).

I totally understand, i wouldn't want to return it either. Dell is kind of p*ssing you about as it is. But i do from past experience that they have left the collection of a faulty pc for some time, but they do come knocking eventually!
