    Legally where do customers stand that have bought through Dell re-sellers ?

    I know Bpat is having a problem getting a refund having bought his laptop through a Dell re-seller, i`m having the same problem too.

    Apparently Dell will only refund the amount that was paid to them for the laptop in the first place by the re-seller and they will not refund a customer directly, it has to go into some other bank account somewhere else and then they pay the customer.

    Do we have legal rights with a re-seller ? As an example mine is just 5 weeks old, i bought mine from a re-seller on Ebay, with these people being classed as traders does the law protect us in the same way as it would do with a major company ?

    The difference what Dell have said they will pay out and what i actually paid for the laptop is around £800 which is approx $1400, ive had the most shoddy service you could imagine from dell with 3 failed engineer visits when they havn`t turned up when stated, a failed part that has failed again, now ive just found out that the battery after just 5 weeks is basically a dud.

    Do we have any rights ?

    I have to admit I know very little about re-sellers or fleabay, but since no-one else has had a go....

    Assuming you paid a fixed price, SoGA should cover anything bought from a trader and that's who you have the contract with. If the re-seller is acting as an agent for Dell they should be liable. Anything wrong with your laptop that occurs within 6 months is presumed a manufacturing defect and must be rectified by the supplier.

    Also, if you paid by credit card they may be jointly liable.
