    What are my rights?

    I purchased a refurbished Dell Inspiron 1564 from the Dell online outlet in the UK a few days ago. It was advertised as coming with the Intel i5-520M, rather than the standard spec i3. I know that new customers could option this when purchasing from new.

    I received the Dell receipt via e-mail confirming the spec, listing the i5 etc.

    However I rang them yesterday to query the delivery date and I was told over the phone that it is actually the i3. I rang back today to complain and was put through to various different departments (technical, sales etc). In short nobody gave a stuff about my situation. I actually spoke to one American gentleman, who effectively said tough!

    Now I think this whole thing is disgraceful. Surely if I have bought a machine as advertised and also had an e-mail receipt confirming the specification, they can't get away with short changing me on a low specification processor?

    So I've been told to accept it or return it. I didn't even receive one apology. Not one person I spoke to seemed to even empathise with my situation.

    If I bought a brand new Dell and it didn't come with the correct processor, they would correct this mistake. Surely my rights as a consumer are not any different purely because it's a refurbished model? Surely I have a right for Dell to take it away and put the i5 in it. That's what my receipt says.

    What do think my rights are?

    This page defines your rights within the terms and conditions of sale:

    Section 7: "Dell will ship Product that has the functionality and performance of the Product ordered...", which they obviously didn't do (an i3 does not have the performance of an i5).

    If your product does end up shipping with an i3, I would recommend contacting the online tech support to see about shipping an i5 motherboard to replace it as soon as you get it.

    Well I spoke to Dell yesterday and there attitude was "it must have been a mistake on the website". Well I have an e-mail receipt with this same "mistake".

    I know Dell do seem to be notorious with bad customer service, but even so I'm amazed at their attitude which seems to be effectively giving me the finger.

    They don't seem to get my point. I've received an e-mail this morning stating "Sorry to hear this. I do feel for you. I will try to get someone from tech that could confirm what order was released by Dell". This isn't the point. It may well be that Dell meant to sell me an i3, but that's not what they advertised or what I have a receipt for.

    I seem to be going round in circles! All I want is what I paid for! Should that be so hard!

    If technical respond on Monday with "it was released as an i3" Sir, what do I do next, it's almost like they're deliberately not understanding me, to try and save them the hassle of rectifying the situation.
