    He may have not known that they case had been closed. I had it happen to me but after a week I started emailing and calling again.

    I filled out the online form for unresolved issues and was informed after explaining things that I'd get another system. Dell has failed again. I sent an email expressing my dissatisfaction and told them to cancel it. The support person even said he'd request an XPS M1720 with SLI.
    Got an email today and htis is what is being built
    What total crap Dell has served up. The video card is much less powerful than my current one and the display resolution is less. I sent an email to them to cancel the order. Looks like its exec email time...

    I think you should stop whining and be VERY happy with this offer. How is this less then what you already have? You're shooting yourself in the foot AGAIN if you refuse this....oh well, your choice ofcourse.

    The display resolution is less and the video card is much less powerful than my E1705. Looks like its arbitration time.

    Be aware there is a fee for filing an arbitration case.

    If I were you, I would get in touch with the last rep who configured this and kindly request they put you back into a M6400 - if not, accept what they are offering.

    How does Dell's arbitration system work? Hopefully it's not mandatory binding arbitration.

    If it is, I'd think twice before taking that route since the arbitrator is essentially on the company's payroll and the binding part means you can't appeal to a court no matter how unfair the arbitrator is.

    Good luck getting anywhere legally with Dell.

    I took paypal to court and while the judge completely agreed with me and understood the case, I still lost....

    Although I am sure paypal spent some good money to pay for an attorney to drive 2.5 hours away for the hearing (and the standard legal fees).

    I laugh sometimes because it would have been cheaper for paypal to just give me my money than pay for attorneys. lol

    It may have been cheaper, but sometimes that is not the real issue. If one case wins, it sets a precedent for others which would potentially cost a whole lot more.

    Lemme guess, Paypal got you on the sort of technicality that lawyers get paid to know about?

    Or they could've just settled without admitting anything. Besides, I'm guessing this case is over something insignificant like $50.

    I don't think there's a case here anyway. The new GPU isn't "much less" powerful as what he has now. The first 3650 HD with 256mb was a bit less powerfull than the 7900 GS, add to that the extra 256mb and it'll be pretty much equal. The only thing is the screen really.
    But remember that Dell already offered him a MUCH better system and he simply refused it based on completely wrong assumptions about the GPU.
    This time they give him an equal system, the screen being a lower res but all other components and also the platform itself is newer so the system IS better by any means. That'll be a hard case to make i think.

    Update:

    I have a Precision 6400 as a replacement. I am keeping it. It has the FX2700M card. 160GB 7200 RPM drive (I have to verify the RPM), 1920 x 1200 LCD and the Core 2 2.4 GHz cpu with 2GB of memory. I am keeping it. My old system is all but dead now. I was told the M6400 is a new build but there are indications that it is a refurb which is what I expected anyway. Thank you all for your insight and opinions. :)

    Nice! Glad Dell made that offer again. And you can upgrade it all you want. There's 4 DIMM slots so you could even get 8gb RAM cheap ;).

    Thank you everyone. :) I may upgrade the memory after I get a couple of minor issues with the speakers/headphone jack fixed. The entire process was a learning experience and I know I have made mistakes along the way but the good thing is, I have learned from it. The advice given was great and I do appreciate it.
