did anyone sue and win a refund instead of accepting "repair"
theres a UK site nvidiadefect.com that discusses getting refunds but theres no US equivelent site i found yet.

According to the US lawsuit, you were entitled to a replacement unit if it was in warranty.
Anyways there is no point suing OEMs as they did not provide the chip. Nvidia has the settlement, albeit it is only a fraction of how many people affected. You can start your own settlement. -
I think you are mistaken..on a couple points.
The OEM was suppose to design , research, prototype as well as QC and test the parts and product so as not to phuk us as they did. the OEM ALWAYS bears that responsibility.
I think the settlement site only offered repairs for Dell owners.
Also Dell is also the retailer,. sue them as OEM is not the point.. retailers also bear responsibility for defective products.
