well, seeing as how the 8400's are the same in all lines (1420/1520)
and the 8400 is ddr2, while advertised ddr3
should i wait untill i recieve the laptop to call up dell
or do it now and just point out exactly what i said above and get a case number?

The 8400 is not DDR2. I have confirmed it being DDR3 using RivaTuner and nTune. It does seem to be underclocked though, only reaching a maximum memory speed of 500 MHz (600 MHz was expected).

Yes, not because of the GDDR2/GDDR3 issue, but because it is underclocked, giving 8GB/s memory bandwidth instead of the advertised 9.6GB/s which would indicate a 600MHz clock.

Doubtful, Dell underclocked the 7900GS in the old E1705's without much fuss.

That's what some are arguing. I'm still not sure if that's a legit claim as Dell qualifies all their ads with 'not responsible for typographical errors' and so forth. This smells of a marketing department pulling data from NVIDIA without consulting engineering as to what the actual clocks would be. -
I know what you're saying, I just think it's sad that we're all so nit-picky about things like that.... I mean, I know Dell's the big bad corporation here, but really they're giving us a very fair deal on an awesome computer.
