So this game runs great. It detects my settings for high using my ATI Mobility HD Radeon 5730. However, occasionally the frame rate will suddenly drop usually during intensive fights. I turned down the resolution from 1080p as well as setting the resolution to medium but the rate will still drop. So should I find a new card? If so which high powered ones work well in my studio xps?

I'm pretty sure my other stats are fine: 1.7 GHz quad i7 processor, 8gb ram, and plenty of room on my hard drive.

You can't upgrade the GPU in the XPS16, but the 5730 is more than enough to play Fallout 3. Have you upgraded to the most recent video drivers? If it's still stuttering for you, you could try overclocking, there's a pretty good thread on it here http://forum.notebookreview.com/gaming-software-graphics-cards/487795-how-overclock-ati-5650-a.html
