GTX 970 Owners Get $30 From Settlement With Nvidia, Gigabyte, Asus, EVGA
"In February 2015, several people filed a lawsuit against Nvidia, Gigabyte, Asus and EVGA over the inaccuracy of the specs of the GeForce GTX 970. Yesterday, the case was settled, and even though the four companies didn’t admit liability, those who file a valid claim for their GTX 970 GPU will receive a $30 cash payment.

The original lawsuit claimed that Nvidia, as well as the other three companies, posted false specs for the GPU. The advertised specs for the GTX 970 had 4 GB of VRAM, 64 render output processors (ROP) and an L2 cache of 2.048 MB. The lawsuit claimed that card actually had 3.5 GB of VRAM, 56 ROPs and an L2 cache of 1.792 MB. In terms of the settlement, the companies will “make a cash payment of $30 per GTX 970 unit to Settlement Class Members who submit valid claims, with no cap.”

Nvidia GTX 980 and 960 lawsuit notifications sent to Newegg customers
“We have been informed about a class action lawsuit settlement with NVIDIA regarding the [GTX 980/GTX 960] graphics card. Newegg is currently awaiting details about the settlements claims process (instructions, website). Once we have this important information, we will send you a follow-up email with the specifics on how you can submit your claim,” the emails read. A Newegg blog post from 29 July states it has a “full list” of affected cards “from Whatley Kallas LLP, counsel for the plaintiffs” and indicates that “Similar lawsuits get bunched together as a matter of convenience and speed for the courts. So, somewhere along the line, a lot of products outside of the GTX 970 were added.”

Amazon 970s: "if you bought your card from Amazon, you might even be able to get a refund right now. Users on Reddit’s PC forums are reporting that the online retailer is still offering a 20 percent refund on at least some GTX 970 purchases ..."

Class action lawsuits are funny proceedings–not funny, haha, but funny, odd. This is certainly the case with the class-action lawsuit brought against NVIDIA. The settlement announcement came out on July 29 and, hold the phone, the list includes a lot more products than GTX 970.

According to a member of our in-house legal team, this happens a lot with class-action lawsuits. Similar lawsuits get bunched together as a matter of convenience and speed for the courts. So, somewhere along the line, a lot of products outside of the GTX 970 were added.

Below is the full list from Whatley Kallas LLP, counsel for the plaintiffs as well as the motion to approve the settlement. Kurtzman Carson Consultants, LLC is in charge of the distribution.

I received an email from the online shop that I purchased my 970 from. Basically, that I'll get the details for claiming my $30 later once they have received the instructions for the claim process.

 

Hmmm, where do I get my $30.
Although I knew all about "tri fiddy" situation before buying 970, free $30 are free $30

 

I received an email from Newegg about the GTX 960 4 GB I purchased. I wish the "list" Newegg had still exists as the page gives a 404.

 

Did the email only reference the now missing URL, or was there some indication of the refund / remedy?

So far noone has said what was wrong with the other adapters that required Nvidia to make remedy.

If you look at the list Cass-Ole posted, it even includes AMD GPUs. Something careless must have happened.
