I have a laptop HP DV5t, with genuine windows vista service pack 1 and geforce 9600GT. I read on Nvidia website and know that this card supports directx 10, but my system currently has directx 9, how can I upgrade to directx 10, is it 10 or 10.1?

If you updated to SP1 in Vista then you should already have DX 10.1 installed.

As far as I am aware Vista ships with DX10, so you shouldn't have to do anything to get it installed so to speak.

If you're worried about making full use of DX10 effects in games, DirectX 10 (or higher) will only work if game you're playing has been developed to take advantage of DX10; increasingly, this is more often the case, especially with new games. For most older games, however, DirectX 9 is used.

The latest SP2 Release Candidate is out today, not the final SP2 release.
