the picture of the tearing you posted is normal. i have it myself and it doesnt bother me.
not being able to o/c as much as others is also normal since gpus dont perform exactly the same even in similar models.
im no expert but i think if you had a hardware problem your issues would probably be worse.
if it really bothers you and you bought it locally, you could consider RMA'ing it.
otherwise, you could just enjoy it for what it is. its still a great machine imho.

Download Rivatuner, then go to the Rivatuner entry in the Start menu and click on D3DOverrider. Set it to start with Windows. Set Force triple buffering and Force VSync to ON.

    Done.

I just have one thing to say: wonderful!
Thank you a lot Kevin, +rep.
This method worked fine! I just don't have more the weird tearing in BC2!
I'm using Vsync off in the game settings and in CCC options (I'm using OpenGL triple buffering ON in CCC,is that right?). CCC Vsync just didn't work well, but this D3DOverrider worked good.

But,nothing is perfect. I want to say I'm already glad with the solved tearing problem. But I still get some ''locks'',wich could be just only an impression, because it doesn't decrease FPS.Besides, sometimes I'm getting suddenly decrease of FPS. It reduces to 9 FPS,but it increases very fast after that and gets back to normal. It didn't happen all the time, maybe 3 times in one hour, and It took only 5 seconds to get back to normal. What could it be? Maybe temps problem?

Anyway, the game experience is just far better without the weird tearing and I'm happy for that. Now I can really enjoy the game, despite of these suddenly FPS drops.
    Any thoughts?

    I only tested BC2,tomorrow I'll try Assassin's Creed2 and see what happens.

PS: Does anybody know if there is a BC2 hotfix (patch)?
