I have a HDX16-1040us laptop. I want to replace my hard drive (it is currently the default one which came with my computer). If I buy one which is different from that model, can I still use ProtectSmart/Rapid Storage Technology?

You wont have anything installed wich has been installed by HP.
No protectSmart/Rapid, no Launch buttons, not working FN keys.
The hard drive is special made by Intel of HP.
    But I could be wrong.

What you can do, is to purchase recovery discs kit.
With these discs, you can install original programs and
it will also install a recovery partition on it.
    So what you want, too.

But about the working ProtectSmart/Rapid Storage Technology,
I cant answer that truely myself.

Rapid Storage Technology should work on a new drive but I am really no sure about protectsmart. When I took the hard drive out, it was a regular hard drive with no sensors or anything so maybe the sensors for ProtectSmart are inside the computer seperate from the drive so if you install another HDD, they would work. And you can put another drive but you have to clone the existing drive or install the same copy of windows that came with your laptop if you do not want to buy activation. With a clean isntall of Windows, download hp drivers from HP's support website and you should be set.

If I backup my system using Windows Backup, would that count as cloning the drive?

Alright. I had done a backup of my system recently using Windows Backup but it seems that it can't actually clone a drive. I might try Clonezilla in the future.
