Actually....I wish they'd let us choose between the two. I had to replace the dv9200 almost 2 years ago with another 17". I've wanted a netbook for years, because of the portability.
Or, if the two replacements stand, and if there's a TX owner in Northern MN or Northern WI who wants to trade for the (non-tablet) CQ56......
-
That's funny, just goes to show how different people see things differently, because I think I'd prefer the CQ56 over the Asus they're trying to pawn off on us tablet owners.
-
I believe the change is only made (CQ50 to CQ56) due to the lack of availability of CQ50. If this is for any other reason, EEPC also might have changed.
-
They do not even believe the babies are still working
-
Yeah, I'd much rather take the Compaq over the Asus. Or maybe three Asus netbooks, that'll at least equal the monetary value that I lost.
-

Well, I was holding off from making phone calls until the site was updated. Now that it's updated, I'll be on the phone tomorrow with anyone I can contact.
I submitted my claim probably an hour after the site went online originally, and still haven't gotten anything in the mail. Have any Tx owners received anything or is it just the regular HP system owners that are being mailed letters so far?
(Still trying to look optimistic) -
-
In my opinion, both counsels are trying to find a medium deflection point where most of the class members will just give up and accept their replacements without further delay. Their incremental steps, without being transparent clearly shows their true intent.
What is most disappointing and even disgusting is that Millberg & Co is supposed to represent us!
We need to keep in mind that at no time, from the beginning (class action notice) to the end (final settlement language), anyone mentioned anything about replacements being "pro-rated".
I am willing to bet that had they made this little information clear from the beginning, many more people possibly would have opted out from the class and altogether and individually sue NVIDIA.
Is CQ56 better than CQ50? Yes.
Is it in the same value category as Pavilion computers?
Let me ask you this. If Compaq Presario CQ56 indeed is "...a new replacement computer of like or similar kind AND equal or similar value to the consumer at NVIDIA’s expense.", why would HP STILL maintain Pavilion and Compaq Presario models separately?
The bottom line is that we, as class members, have been duped and deceived by our own counsel. Instead of coming up with fair and equitable solution, I feel that plaintiff counsels are colluding with NVIDIA to make this issue go away as quietly as possible.
In addition, NVIDIA's misrepresentation of their true intent to the court as well as class members should be punished legally and financially.

Write your letters to the presiding judge.
File the complaint with FTC.
Contact your local media who is hungry for a good story of today's version of David versus Goliath.
Don't give up because that is exactly what Millberg and NVIDIA want you to do. -
I am repairing my DV9000 series laptop (purchased a new motherboard, fan/heatsink and a processor all online for about $220) and then putting in a repair claim if I get it going. I am not sending it in if I get it working unless it fails again before the return deadline. I have lots of gear that uses the Expresscard slot, Firewire port, cardreader slots, etc. and the CQ56 has none of these! It's just not fair and not of similar kind and value as stated in the settlement. -

The compaq sucks..... I had a compaq desktop and a compaq laptop (office) few years back. This is the exact reason why we paid more to HP.
I would like to get at least some HP pavilion, or some cash to invest on my new PC if at all possible. I am pretty much clear, this will not happen. -
Come on Milberg this cq56 is still miles away from my DV9000. This thing might be close to the dv2xxx, but even then it's a stretch. And no changes for the tablet owners? Unbelievable. On a positive note, we at least know that the model and website can be changed. On a negative side, it might seem that it's going to stay that way. I plan on waiting for a while for things to pan out, and if nothing changes I will send my DV9000 in and sell my replacement on Craigslist for 300$ and put towards a 1/5th scale RC buggy lol. I also now plan on sending my letter in to milberg now that we have more terrible information concerning the replacement and also still waiting on Mr Frank's reevaluation that was supposed to be addressed on the center for class action fairness website.
-
I have been Patient, I have been Polite.
Neither of these attributes is in my nature.
I shall take a MUCH stronger approach when I call Milburg tomorrow.
It will Rain in Hell before I take a 15" compaq in replacement for my Dv9.
as for the replacements it Took a month for the Lawyers to come up with this crap!!
I was born at Night but not Last Night. -

no, we cannot sue Nvidia for anything related to the computers, having all ready signed the paper. however, we CAN bring to court that they are NOT fulfilling the terms of the settlement agreement as per the judge's orders.
letters are being sent out and computers are being sent in all ready. we need to take action now, not wait for it to be too late.
i have also noticed that mr. Frank has not updated his blog today, which i find curious. i would definitely like to know what he was able to find out.
do not hesitate guys, call Milberg, write letters to the people in charge (addresses and instructions a page or two back). -
@ Shasta, Core and Matt- I completely agree with you guys. I currently have a Sony Vaio 2.8 gig that works wonderfully that I picked up off craigslist for a mere 100$- installed newest drivers, Avast, and regular performance maintainance and it is flawless. My point is that I do have time to hang in there for a little bit longer. I also can't wait for the day that I don't log on to my computer checking three different websites to find out new information about this dastardly claim settlement...
-
Ohh yeah, I also scored the three of you guys plus 1 rep. For your unbiased, positive posts that have been helpful to myself and many others I'm sure.
-
As usual it would be nice if they specified which CQ56.
-
i know some of you do not think the petition helps anything, but it also does not HURT anything to take 5 seconds to sign it. i also updated the petition with the more current info as well as a link to this forum. at this point, we really need to do ALL that we can to get this settlement enforced. -
and Werdnerf:
lol. i noticed that as well. they only made the replacement specifications SLIGHTLY less vague than they all ready were...and in doing so flipped us tablet owners off as well.
you know, it isnt so much that they are trying to pull one over on us that is really getting on my nerves (ok well slightly but that is besides the point), it is the fact that they have YET to define WHY these models were chosen and explain HOW they meet the terms of the settlement. you know throwing up a short explanation about the depreciative value over time compared with outdated hardware and blah blah blah, would actually help their case out quite a bit, pertaining to the public i mean. but instead, we get no explanation. this is what aggravates me the most; that they do not even have the decency to TRY and make it look like they are following the terms. they just expect us to roll over and take what they are giving us.... -

Mr. Frank posted an update! Here's the latest:
Update, February 10. The settlement website has been finally modified: claimants deemed ineligible between January 10 and January 22 are encouraged to resubmit claims; the replacement computer remedy for HP notebook computers will be a Compaq Presario CQ56 computer, rather than a CQ50. That still doesn't address the tablet problem; leave your comments on your thoughts about the CQ56. Mr. Westerman has asked me to refrain from action this week (and, frankly, the press of other commitments in existing cases would mean that I would need to do that anyway). Please remember that I am not your attorney and cannot provide individualized advice on how to respond to the settlement, and please do not rely upon me as your only recourse; there may be other attorneys willing to look into this. In particular, I encourage you to contact the consumer division of your state attorney general's office. I will check back in with Mr. Westerman February 15.
I get the impression that nothing's going to change, I hate to say it...I think we're being strung along by Milberg & co. with all these talks about meetings, updates etc. The lawyers got their millions; whether we're happy or not, they could care less. -
Ok Today New Letters (snail mail hard copys) Like last time, phonecalls to milburg and the newest Name to add, as I read the documents the lawyers used a third party arbiter, a judge who specializes in this kind of thing, add him to your list:

I don't know about anyone else but they always ask if you would like email updates but I have yet to get ANYTHING !
-
well, it seems Mr Frank is out of the equation now. we really need to keep those letters going and keep with the phone calls to milberg and state attourneys. dont wait for things to happen, we have to put in the effort to make it happen.
Shasta, thanks for the invaluable information. =)
joyce, i have yet to receive an email update as well. i believe i need to resubmit my claim also. -
I wished they would have sent an email to me after I submitted the claim, or at least an email that anyone who submitted the claim between those date that was ineligible. Just seems a bit unorganized
-
how do you get to talk to a live person for the lawsuit? I want to call and find out my claim status because i submitted around the 10th or11th of Jan but still heard nothing. i called the number on the site but it's just a computer recording.
-
Press zero at any time during the recording also call milburg @213-617-1200 -
Hey tablet guys! Check this out! Your ASUS replacement isn't even rated in the top 10!

Good going Millberg! -
So frustrated! I called Milberg and the woman on the phone at first told me that all changes to the website had been made... When I then asked her how an Asus netbook was equivalent to the "replacement HP notebook computer" that was awarded in the settlement, she said that maybe she was mistaken and would check to see if there were more changes to be made. She took my number and said she would call back (I have my doubts...)
-
My claim is still is pending. Up to the lady, it may take any where between 4 to 8 weeks.
Press 0 to talk to the representative. Is this mentioned some where? -
I plan on calling after work (I live on the East coast).
-
-
Got a call back from Lady at Milberg. She said the website COULD still change, but there's no guarantee. She said early next week they might know... sounds familiar huh?
I also asked her about depreciated value and she said they didn't use any sort of formula to get value and she never heard "depreciated value" in the court settlement. My response was, "Exactly! I didn't either, but that's the only way you could even remotely consider a netbook a fair replacement for my tx1410!" -

Here is some potentially useful information for anyone wondering about the series of CQ56-1XX models... Hopefully, the high end models from this series is what will be offered versus the low end. Even those on the high end would still not be satisfactory replacements for the dv9000 series.
Compaq Presario CQ56-100 Notebook PC series specifications - HP Home & Home Office products
Sure as heck would be nice if they would be more specific in identifying which model(s) will be used as replacements for which model(s) of the defective machines. All the vague information is very unprofessional and smacks of technical incompetence or evasiveness and deception. -
Link from Mr. Fox in post directly above takes you to HP/Africa.
Model 100 in the configurations shown does not appear to be available from HP/USA. Here, we only get the Z and the 110. The Z can be customized with a couple of different AMD/ATI processors, a larger HDD and more memory. The 110 is a stock item with Intel/Intel processors, 250GB HDD and 2GB RAM. Both the Z and the 110 ship with Windows 7 Home Premium 64.
Doesn't appear to be too much mystery surrounding what will be coming our way. Probably the cheapest of the available processors, and maybe even a smaller HDD, less memory and a cheaper version of Windows. -
-
Think that those who are posting that ALL who filed claims between the 10th and 22nd of January must refile are misreading the update.
The update at the settlement site reads: If you attempted to file a Replacement Claim between January 10 and January 22 and you were deemed ineligible, you are encouraged to submit your claim again.
I received a claim number and notice that claim was successfully submitted when I filed on January 18th.
I'm thinking that maybe there has been some tweaking of models that qualify, and that some who were ineligible before the tweaking might now have their claims accepted. -
