So is still there a way to tell if the half-height 5300's in ebay are legit retail or ES?
Also, what are better alternatives to the 5300 half height?

i was told by ebay that it is illegal to install any wifi/wimax cards into your own laptops as all combinations must be approved by the fcc. Intel told me that they will not warranty anything off ebay and that any intel product on ebay being sold can have legal issues. i told them if that was the case i am sure intel would have issues to ebay a cease and desist order to ebay on selling any intel products.

The only way some people think my card is an ES is that it came from Ebay. However, I'm sure that mine is not. If the label says ES, you have an ES and if the MAC address on the label doesn't match the MAC address of the card itself, you have an ES. The ebay seller explicitly stated that the cards he was selling were not ES and the picture looked like a legitimate non-ES card. The one I got looked just like the picture with a normal and not ES sticker and the MAC address matches the card. The card works great and I have absolutely no reason to believe that the card is not a legitimate retail version. Some sellers on ebay have ES cards and some don't, but you can tell from the pictures and description which ones have the retail version.
Supposedly the top of the line Atheros cards, but good look finding them, and they may not come in half-height, I'm not sure.
The 5300 isn't the Wimax version, and Wimax is useless to the vast majority of users. Still, ebay is retarded. -
I will let you in on a secret
I have been upgrading my laptop wi-fi cards for years
I prefer Atheros cards, but the newer Intel cards work very well too

As for the labeling of the Intel 5300's concerned, there have been reports that even the label can be EXACTLY copied by those in eBay so I don't know. Don't you experience the infamous blinking wifi led problem with the ebay cards? -
i got the 5300 off ebay also as it supports the 5ghz wifi band as well. I wanted the 5350 as a just incase thing of wimax. I installed the intel drivers and then it tells me i have a unknowen device under USB Device manager part. I also tried the IBM Thinkpad Drivers as well. I have an Asus g60 from best buy with a centrino 2 chipset. I was told dell will be having the studio 17 and studio xps laptops with wimax but so far they are not posted online. i went to configure one online and no wimax card option yet. Also no drivers either under any of the latest studio line.... but it may not be until novermber 18 that they launch the newer studio lines.... The ebay seller said they can refund my $59 so should i send it back or not?

the only true way to find out if its es or not is to call intel and give them the serial off it they will tell you then, trust me dont think because of the label as i said its genuine.. normally es cards work fine though so i would not worry about it if it was me.

I replaced the Intel 3945 wireless in my notebook for one Intel 5300 to have 802.11N support; but now I'm not sure the cables are correct.
With the old Intel 3945, the cables were:
- White wire -> 1
- Black wire -> 2
With the new Intel 5300:
- White wire -> 1
- Black wire -> 2
- Grey wire -> 3
Do you think the positions of the cables are correct or change them would give better results? -
it's fine that way

Based on below information:
http://www-307.ibm.com/pc/support/site.wss/MIGR-68273.html
You can try:
Black Wire -> 1
White Wire -> 2
Gray Wire -> 3 -

Download Inssider, and change the antennas until you get the best reception.
I also had to change mine to make it have less noise and interference.
