Before I buy this notebook, custom built, id like to know if it does that stuttering with the 8600 gt. I hear a bios update fixes is that, is that true?

Where from is the stoy for the 8600M stuttering, is'working fine.
And no BIOS update is solving this issue so far as I know, because there is no issue.

Do a simple search and you will see tons of "8600 stuttering" threads. Yes, the problem exists, but from my personal experience I think it's because of overclocking.

Stuttering like what where or when??
I have 2 BTO notebooks both are running the Nvidia Geforce 8600M GT 512 DDR2 versions.
Driver installed is the 167.59 WHQL version.
Games like COD4, GOW, WIC, CRYSIS, MOHA, HALO2 For Vista, Dirt, NFSPS and Silent Hunter 4 are all running fine and no stuttering is detected.

Like vashts121 posted, this can be related to OC the GPU, this might result in stuttering and is no hardware error.
