In 2005 I bought a 6100 series averatec without a battery at a reduced price from Staples. I got on to the averatec site to buy a battery. I was debited $125 and paid a further $15 for a Saturday morning delivery. Then my woes started. firstly I got no Saturday delivery-it did not arrive for four days. When I opened the parcel it was the wrong battery-I think for the 5100 series. I got back to Averatec who sent me a replacement after a delay of six months-you guessed it they sent me exactly the same battery I had previously returned!!! I called them and was told I had no dealings with them and that I had dealt with Ship it for you.com and they refused to do anything for me even though it was on the averatec site I had bought the battery. To date I have two batteries for the 5100 which I do not have and no battery for the 6100 which I do have. I am also $140 worse off. Take my advice and buy nothing from either of these firms-they definitely take your money and have no concept of delivering what you pay for or correcting their errors. I now have a laptop for three years I can only use when plugged in. BEWARE OF THESE COMPANIES

What you need to do is, and I cannot stress this enough, file a consumer complaint against them with the Federal Trade Commission ( www.ftc.gov). The FTC won't step in to handle your individual situation, rather, it will come down HARD on Averatec if it notices a pattern of severe complaints lodged against them (resulting in federal consumer investigation / lawsuits / fines). However, your individual filed complaint is like a permanent black mark put on Averatec's business records with the federal government, and cannot be removed unless you yourself retract the complaint.
I highly recommend filing complaints against ANY AND ALL companies who have seriously screwed you over (not just tiny petty stuff, though). Telemarketing, used car dealerships, and annoying bill collectors are amongst the highest number of complaints that are filed and investigated by the FTC each year.

Next, if you've exhausted all resources of attempting to resolve your matter, file a consumer complaint with the state Attorney General's Office of whatever state a particular company is based in (Averatec is based in California, I believe?). Unlike the FTC, the state AG's office will most-likely send a letter to Averatec to notify them of a serious consumer complaint that needs to be resolved. If Averatec fails to respond, the AG's office will start an investigation. The state AG's office also retains files of any and all complaints that have been lodged against a particular company. Again, these remain as permanent black marks against the company unless it is rescinded by you through appropriate paperwork.

Lastly, after you've filed your complaints with both the FTC and the AG's office, contact Averatec (or any company that screwed you over) by certified mail to inform them the problem is now being handled for investigation by both federal and state government agencies. Be sure to include copies of your complaint along with the assigned case number issued by both agencies.
This is sometimes enough to scare the sh*t out companies to resolve your matter ASAP!

So... www.ftc.gov, and any state's Attorney General's Office (where the particular company is based)... two consumer protection agencies that are available to use, but very few people ever realize are available to them.

I whole heartedly agree with G21SF. The FTC, California AG and BBB all have complaints from me against Averatec. And take to heart the statement in the previous post that these entities do not legally represent individuals. So many complaints have been filed against Averatec that its management just doesn't seem to care anymore. It feels like the South Korean investors studied North Korean attitudes.
