Playing Diablo 3 just now I experience a screen blank out + windows message stating driver had crashed and recovered. After returning the screen was full of graphical glitches and artifacts and crashed soon afterward. Now when starting any game they usually have artifacts and glitching and will freeze to the point of being unplayable and will usually crash shortly afterward.

I tried updating the driver and uninstalling the old, didn't fix. I used GPU-Z to check temps and they were around 40 idle, and 70 with a game running.

Is this likely a hardware issue and the thing is fried?

Those are common signs of a malfunctioning video card. I believe you'll need to RMA it.

Yes, I was afraid of that, put in a support ticket and already got a speedy response and they said the same thing :(

I wouldn't be so sure... I used to get that error quite commonly on my Malibal P150HM and reinstalling the driver did nothing for me. I ended up having to reinstall Windows and for some reason after that was done the errors stopped. I've had it happen across 3 OS installations but it's not something I can duplicate so I'm not sure I'd be able to RMA anyway and I've been running my current install for months without problem. My advice would be to reinstall windows and see if that fixes the problem before sending the computer off.

Well I can always try it, but it's not just the error though. I've had it happen to me before as well, on several different computers. But this is a first time I've had a problem with graphic distortion and freezes/crashes.

I didn't mean just the error, I also experienced heavy artifacting and discoloration after the initial error message and crash.

a screenshot of the artifacts would certainly help
could you also post your spec on here so we can advise further.
at least the temperatures are fine so we know its not one thing but it could be many others.

also i get this error once w/ the latest driver.

i use the charger everytime i play cus i lag when i play dota 2 w/o the charger.

Is it graphic card failure? should i try to re-seat it?

when you say using battery charger do you mean its plugged into mains or on battery.

might be worth trying to reinstall your latest driver doing a manual safemode install cleaning with driver sweeper.

I had similar problems three or four months ago, it would happen every few days even when not gaming, I sent it in, they replaced the GPU, and everything has been fine and dandy for the past few months.

Here are some pics of what was happening to me, although they were not limited to these two types of occurrences, only thing I can suggest though is to send it in, as nothing I tried ever successfully worked. Pardon the huge amount of crap I have running in the first picture.

o my. mine isn't that bad, but i just had some instances where the graphic card fails and the screen flashs black screen and the message "kernel drive has failed and is stopped responding" comes up. I sent in the ticket and they said 560M card has many instances of those. I hope mine gets fixed with the new card.

Yeah, mine was pretty messed up, hope your problem gets resolved quickly. I live on the east coast, and it took about two weeks total to have it sent/fixed/returned.

Well, you are fairly close to them, so that's in your advantage.

Jaug1337, assuming his problem was the same as mine, all of the new drivers in the world wont fix it, I tried 15+ different drivers, beta and certified from 268.78 up to the 295 ones, and I experienced the same problems throughout all of them. Just so you know.

That's NOT good. Sometimes I have the same distortion as your second picture and my laptop would completely freeze up. I have to hold down the power button in order to get it back up and running. I don't think the OS has anything to do with it as I'm running Linux. Until now I always thought it was software issues :(. mrblings and my laptop are around the same age, during the holidays of 2011. Around black Friday. Perhaps there's a bad batch going around.
