    man with all this time / shipping even on widow's part you would think they would have just replaced it by now..

    Yeah, tell me about it. Most recent update just leaves me wanting to laugh and smirk.

    Now that they got the laptop from the repair facility themselves, it failed... in the exact same manner, exact same symptoms. I was on the phone with Brandon as it happened in real-time. They have their own proof that confirms what I've been saying. I just have to wait and see if they'll actually decide to give me the replacement I should be getting.

    *laughs and smirks* Sorry... but it's just nice to be in one of those "I told you so." moments. :D

    I say they should initial you a full refund, you can get much better spec with those money now.

    Well, if they did give me a replacement, it wouldn't be the D900T again. That has been discontinued for a while, same with the D900K.

    They've said previously before when mentioning replacements that a replacement for this system would be for a comparable current model. Which leaves only the M570RU and the D901C as options.

    Of course, I'm just guessing at that. There's still a chance they replace with a crappier spec'ed system.

    I'd consider looking for a lawyer in the Austin, TX area that would take your case on a contingency basis. I'd want every single penny back.

    Ah, finding one in Austin, TX is not feasible. WidowPC is owned by Silicon Mountain Holdings now which is HQ'ed in Boulder, CO (I think).

    Also, since I'm Canadian, having tried contacting a couple US lawyer firms previously... well, they won't even give me their advertised 'free consultation' since I'm not a US resident/citizen. Basically told me to bugger off and go find a Canadian alternative. However, Canada doesn't have anything legal I can use as far as dealing with these kinds of cases. At least the US has the dubbed "Lemon Laws".

    As far as charging back credit card goes, my mother (which the purchase was made on) doesn't want to go through the trouble and she disagrees it's even do-able by the bank/CC company since it's been so long since the initial purchase. Not only that, the company changed hands and they're at least honouring their 'weak' warranty policies. If it was my own CC, that may still be an option but I don't have family support on this (every penny spent has been out of my own pocket so far); they just don't want the trouble.

    Shyster1: I agree, it was classic. I was caught off-guard. I really didn't expect it to fail while I was on the phone with them. I had thought they'd find nothing wrong, send it back, and then I'd have it die on my end shortly after. But this works out much better, I agree. :rolleyes:

    so how much you've paid for repair so far? I think the lawyer is gonna charge you far more than what your notebook cost.

    Around CAD$2000 give or take $50-100 or so for shipping, parts, customs/taxes. I wouldn't have had to pay the lawyer anything myself if it was done through the "Lemon Laws", the company would have to pay my legal fees. And if I didn't win, there's no cost to me (according to the policies of the firms I contacted).

    There are many lawyers who will take cases on a "contingency" basis, which means basically that they get paid if and when you get paid.

    To me, it's a simple case of breach of contract. You paid for a working laptop, and they failed to deliver one despite the fact that you paid them. You have also suffered incidental damages as a result of their breach.

    You likely also have rights under any warranty you purchased.

    FYI - Lisa Cook probably didn't understand what you meant when you told her that it wouldn't POST. She is not technical at all. Nobody has any idea why she's in her position.

    Thanks again for this information. I'll be contacting the CEO, CFO, and COO directly in a short while, if I can even figure out what to say. Just got screwed again by the company and while I was told Lisa's boss knew of the situation, I don't think the higher-ups are really aware of how bad a public relations case this is. Even though I was told the bosses were made aware, it seems ridiculous that they would do the bare minimum considering the circumstances.

    You don't make claims on your company's website claiming top-tier support then hide behind a warranty policy despite special circumstances and give me the runaround.

    Blegh, I'm not even sure what to say to the CEO, CFO, and COO at this point. Will they even side with me? I get the feeling, no. *sigh*

    Wow, that's pretty shocking. I didn't think the company was in that bad a shape. So basically they're not even turning a profit, huh. No wonder why they refuse to replace the system... it seems they can't even afford to?
