it was not the key itself. the keyboard itself was to tight in the hole for the keyboard and it was getting "tweaked" kinda. the corner where the esc key is was getting caught on the plastic when trying to get it to go in the hols and it was a TIGHT TIGHT fit. the new one they sent was the same way. so i taped off all of the keys and went around the edge with a dremel in that corner not touching the black at all. i only removed a tiny bit of metal but it slides right in now and no key sticking or making a clacking noise when pushed down. if i would have known this sooner i would have not even bother to request another keyboard in the first place. problem solved and i have to say sager was AWESOME through this process.

im sending back the new one they sent me since my old one is just fine now. no reason to send them the old one when it works fine.
