    *Help* Cancelled order on Sony Vaio but still shipped?

    Hey guys, I ordered a Vaio on the 2nd, cancelled on the 4th and it was confirmed through email, phone rep and online that it was cancelled with no charge to my CC. However, i just received a package today and of course its the Vaio i cancelled. I dont believe i have been charged for this, and its obviously their fault. So what should i do?

    Haha! That slays me. Sony is such a bloated, bureacratic cow of a company, they really need to reorganize and streamline. Poor customer service doesn't motivate them, but I bet more mistakes like this would. :D

    Well first, check with your credit card company to make sure you weren't actually charged, and that there are no pending charges. If you really weren't charged, the right thing to do is contact Sony and let them know you were shipped a computer that you canceled. I will die laughing if they ask you to pay for the return shipping. :D Of course do NOT accept that.

    If you're evil, keep the computer. :p

    You may be able to justify (to yourself) keeping it, but do the right thing. It should be returned, but returned at Sony's expense. Call them up and have them arrange the shipping.

    Because karma never fails, return it. Call Sony and tell them but DO NOT pay for shipping, have them do it and arrange it.

    But I would be curious to know if they would contact YOU on their own about the laptop...

    In conjunction with the moral aspect; they may be slow and bloated but they will discover the error and they will bill your card if you accept it. And the charge will happen when you can least afford it probably.

    It's too late now, but in situations like this, do not sign for it. The big shipping companies will happily return it whence it came, and charge the shipper's account for the extra shipping charges.

    Signing is accepting, and the onus is now on you to contact the seller to have the merchandise returned, even if you earlier canceled the order -- your signing is a later action, and takes precedence.
    Since they don't want to lose you as a future customer, they'll probably pay for shipping and waive any restocking fee, but don't count on it (especially not if buying from certain camera stores in New York that have made selling people what they declined into an art form). Sony Style should be fairly easy to return to, though.

    thanks for the replies guys...I wasn't home and a family member signed for me.

    I'm just wondering what can happen if I don't call Sony and don't open the product and wait it out to see if they contact me about it. Also to see if I am billed when I receive my statement at the end of the month. What are the consequences of doing this? And if they don't contact or re-charge me technically I can keep the laptop? (yes I know this isn't the "right" thing to do) but it was their error and I can't help but consider that option.

    I wouldn't wait for a statement. If you "paid" with a credit card, call your credit card company or access your account online right away and see if there are charges or pending charges.

    I was joking in my earlier post when I suggested you keep the laptop (notice that I said "if you're evil" ;) ). I don't think that's going to work out in your favor ultimately.

    You may think possession is 9/10 of the law, but even so, that 1/10 can be nasty. Sony made a mistake, but you are now in possession of what could be considered stolen property, depending on where you live. Consider articles like this, this, or this

    After a bit more research, I did find this which is interesting, though I'd seek legal counsel to really understand what it is saying. My very limited research makes it unclear whether courts would consider your case detinue or not.

    All that said, if I were you, I'd return it - legalities aside, I think it is the ethical thing to do. If everyone took advantage of others' mistakes, it'd be a harsh world to live in.

    Thanks for the replies..it's just what If I call them and they expect me to pay/arrange for return shipping even though I did the right thing by calling them. When instead I could technically keep it and they may or may not ever realize it.

    Anyways, I contacted my CC company and there are no charges or pending charges.

    I will probably phone them but It would be a shame if they forced me to pay the return shipping just for accepting the merchandise because of their error.

    Absolutely refuse to pay the return shipping. If they ask you to pay it that would be the epitome of bad customer service. But having said that, it's exactly the kind of thing I can see them doing, so definitely a potentiality.

    I think you need to just push really hard on that point. You are doing the right thing by taking time out of your schedule to inform them of a product they basically just gave to you for free. That warrants a reciprocal amount of consideration on their part.

    It depends:

    If it arrived via USPS, then it falls under receiving unsolicited goods. Then again, the documentation that comes with it may not help you at all.

    If it arrived via UPS or FedEx or anyone else, there's no legal protection at all. (As far as I know)

    I remember one time a dude did a "free macbook pro" site and the company sent him a palette of MacBook Pros. He did the right thing and they gave him nothing whatsoever for his good deed lol. :(

    It arrived via FedEx, and I live in Canada. Not sure if that makes a big difference or not legally.

    I'll probably give them a call tomorrow and see how it goes.

    Just call them, you should not be afraid of having to cover the cost of returning it. It was obviously their mistake, and any respectable company will assume the responsibility of correcting an issue like this the same way they would if they ship you the wrong item, an item dead-on-arrival, etc.

    Sony will not charge you a restocking fee or shipping fee if you are returning their big mistake. Don't find excuses :)
