Yes and no. A couple of things to consider...
When you use anytime upgrade, you DO NOT get a new product key that allows you to just install Ultimate. You have to use your original product key to do an install, then go through a PITA process once its installed to re-upgrade to Ultimate -- not exactly consumer-friendly.
The EULA isn't going to stop you from doing what you want to do... but that doesn't mean you can easily do it.
You'll still need to "acquire" an x64 Vista DVD in order to do the installation. If you purchased a retail copy, you can use the provided MS website to order an x64 DVD that your existing key works with.
If your existing installation is an OEM copy, you'll need to "borrow" a 64-bit DVD, and hope that your OEM product key works on it (reports seem to be that OEM keys WILL work on standard retail 64-bit installation media -- but I don't have a way to try that for sure).
So, yes, you "should" be able to migrate to x64 later... but it's not in any way related to using AnyTime upgrade to update to Ultimate.
If you get ultimate from anytime upgrade, can you later on install to 64 bit?
