I ordered a new OEM Vista Ultimate 64 DVD and it arrived scratched![]()
What are the courses of action available?

Contact the Vendor and ask them a replacement , I am sure they will do it

How badly scratched is it?

If it doesn't work use Brasso to heal it.

The scratches are pretty bad and I was under the impression that once you open the seal, you can no longer return it...sigh...

Ask them to send a replacement. Also, you can (for $10 or so) order replacement media from MS.

You shopuld also be able to download it online as well. Atleast with Office, etc you can download the install files and then use your key to activate it.

Microsoft no longer has the downloads for the Vista discs. So your best bet would be the replacement media as suggested above.

Got in touch with mwave, they are sending out a replcement DVD. Interestingly, MS refused to replace it or offer a download link for it since I am a dirty OEM customer.

No, they refused to replace it because they sold the OEM copy to a distributor who sold it to you. It is the distributors responsibility to replace it and then return it to MS. MS is then responsible to replace the distributor's media. Technically you are not Microsoft's customer in this transaction.

It has nothing to do with your bathing habits (or lack thereof
). Under the Microsoft licensing structure, Microsoft licenses the OS to the OEMs under a license that includes a limited right to sublicense the OS on to end-users (e.g., you). In that instance, your relationship is not with Microsoft but rather with the OEM from whom you sublicensed the OS; accordingly, you have to look to your OEM, not Microsoft, to replace the physical media you received along with your sublicensed copy of _Vista.
