    Acer travelmate 3040; eRecovery problem

    Bought Acer 3040 few days ago. Went through vista install on first boot.
    Decided after completion to do ERestore, went to icon in Empowerment toolbar.
    Selected full system backup to either 3 cds or 1 x dvd. Selected 1 x dvd option. Followed instructions, backup completed ok onto dvd.

    Vista was running bit slow & crashed couple of times. Decided to install xp pro instead. Installed xp from an xp pro microsoft disc. kept the pqservice partition & formatted both c & d Partition. xp installed, couldnt get driver for acer orb cam. Decided to put vista back on from Erestore dvd created as from above.

    Restore went through ok interms of back to factory default with vista. HOWEVER the last part of eRecovery 7/8 "installing restore system" Seems to go on forever. If end task on acer empowerment & launch pad it disappears.
    But on REBOOTING Laptop, it'll do the install restore system again!!!! eRestore icon doesn't appear on acer empowerment tool bar

    PLEASE ADVISE; If I have had laptop less than 14 days can I get acer to swap laptop out?
