have you called consumer protection agency?
go to court perhaps? small dispute are not expensive and long term, it is supposed to be one time charge only. but check with your local area before you do so.
btw, what did u use to record? how did u do it? is the recording sound clear? did you show the tape? i've tried to record conversation on digital recorder but none sound clear enough... any brand/model suggestion?
i think if you say something like, hmmm... i wanna see if your excuse hold up in court sir. they might think twice.
have you tell the store you called acer? ask them what more do they need in order for a laptop return.
ah almost forgot.... is it possible for you to attach some of the photo of the defect? -
You have a good chance to score some good $$$. Dont just accept a new laptop
Go to the doctor, complain about nervous breakdown, lack sleep, etc etc. Tell him youve been accused as a liar, about this whole conspiracy or what not. Exagerrate or whatever, be creative. Get prescribed on something strong(dont consume it tho). Emotional Trauma(+punitive damages possibly?)You wont even a need a good lawyer for that, just someone who can do this whole process for you of filling court papers etc.
Remember, this is not a single person, its a freaking ACer youre talking about, and with evidence like this most likely they will settle FAST to avoid a trial. Acer wouldnt want something like this being public. Even if you dont need the cash, think from the bright side, hopefully you will ruin this manager guy's Sleep for a week or so
Seriously I know this sounds like too much, but if the situation is like you describe, youre VERY lucky, if you take action. Dont let *** holes step over you. -
Warranty coverage or not, you have a serious legal case here. So if your warranty expires within 5 days do not worry about it, since you have some serious paper trails here that really help you out.
I would, for one, find and email all the Acer execute officers stating clearly what is wrong, how many times it has been in the shop, the persistent lying, etc, etc. Be short, sweet, and factual. Make a point to send a copy via registered mail and also make a point that a copy of this all is being forwarded to any consumer protection agencies that you have available.
Also in the letter clearly state that they have 7-14 days from the receipt of the letter to fully resolve the issue or you will contact your lawyer to sue for the full amount of the laptop plus your time and efforts. You are completely justified in asking for the full price of the laptop AND a few hundred dollars extra for your time.
Then contact your lawyer, so that he/she can prepare your case and be able to file it on the 15th day after they get that letter. If it gets to court, you can probably claim triple damages (3x value of laptop) if you can prove they intentionally tried to deny you your warranty or other rights. -
keep up the paper trail::
email ACER daily... even 2 or 3 times daily... send them a copy of the AUDIO FILE from the taped conversation... send them copies of the emails you have already send...
i'd settle for a NEW TOP OF THE LINE MODEL.. ONLY.... nothing less...
also contact the Better Business Bureaus and CC the email to ACER...
maybe they will get the message if you start to paly "hard-ball" -

Yes indeed, I'm seeking money + interest as well as some damages. I'm never going to use another Acer computer in my life and I'll prevent everyone I know from purchasing that brand.

Recording a phone call without the other partys consent is actually illegal in some countries/states. It breaches privacy laws which makes the recordings inadmissable in a court of law.
