Hi I have a aspire 5738z when I use it on the tv there is no sound,
it did work last time i tried it but I seem to think it was before I did the windows 7 upgrade not sure I have searched the forum and tried what I have found and there is no option in playback devices for hdmi only the 2 one for speakers and one for Realtek Digital Output is this right or should there be a third for hdmi?
if so how can i get it to show I already have shoe disabled devices checked as well.

In playback devices you should find an option with the name of your video card. Also, be aware that ati requires you install the audio hdmi driver separatley, check their website. You could do the same for nvidia, tho i haven't encountered such a problem on nvidia.

Tried the suggestion you made downloaded the ATI one but it wouldn't install as there was no card so it must be the other one so went to there site did the update finder and it said go to the acer site so I'M back to the start!

Not sure what the problem is but yes you should have Digital Output Device (HDMI) as an option in the playback device menu.
