The last thing I heard was on 3/3 he was saying my laptop would be shipped within 3-5 days. Thats before I found out all of this was going on.

I was told the laptop would ship in 3 to 5 days on 3/3. I haven't heard a word from him since then, and have emailed and called him as well. I also started the process with paypal to resolve the issue. The next step will be going through my bank with a chargeback request.

apparently are friend brian use to own a company called, smith of denver web design which is no longer, at least as far as a website is concerned...

So I am assuming that only way to get my $108 dollars back is by joining in with the legal suit with the rest of you or just giving up on it. Or maybe Brian will come through in the end, you never know.
From these others posts that I am reading, it sounds like Brian is involved in a bunch of get rich quick schemes that seem to keep going bankrupt. I guess I have a reason for his snotty remarks to me now. I had no idea that I was older then him either.

What concerns me is there is no better way to judge the viability of a company other than resellerratings.com. That thing can be inflated. RJTech just as an example, doesn't have an inflation problem, it just has NO reviews for the last 6 months.
I'm very much in support for small business, but I wasn't aware so many PC offerers were sooooo small. You get a website you can be (big?) business too. Flawless definitely overextended, having 3 brands of laptops with umpteen models and configs for each. Probably never had a single one in stock. At least some of the other small ones (and I won't even sully their name by mentioning in this thread) keep their model count low and hopefully thus can provide better on what they do offer. And as for having those horrible 3rd party warranties through Phillips and the like, that might be better than through a business that may not be around in 3 years.

Update... Brian's family has posted a note on R.R. site. They are not happy over the phone calls they are receiving for Brian. It is posted they understand people are upset and are working on the situation, trust them.

No ancientgamer, trusting would be stupid. People who were ripped off have no reason to trust right now. His "parents" will just say they are sorry but they can do nothing about it later like they did a week ago when I called. Now I am not going to keep calling their house, once was enough. But other people who haven't talked to them are going to call, and too bad for them. Deal with it.

You know, I'm not sure who I would be more upset at, Brian or his parents. Seriously, at the age of 22, you are legally considered an adult, but that doesn't mean that your parents can't or shouldn't offer sound wisdom, such as "gee son, maybe you should be careful not to over-extend yourself with all of these ventures" or "slow and steady wins the race". The excuse "we didn't know what he was up to" is not a valid response when he was living under your roof and using your phone number on his business' web site!
If your son is working out of your home and using your phone number as a point of contact for a business, you are an irresponsible fool in my book. You're not going to get any sympathy from me. Your son has floated on lord knows how much money from customers, and you have the nerve to demand that people stop calling? Are you kidding me?
I'm sorry, these may sound like harsh words, but this situation has cost honest people hard-earned money, and your son is responsible. Leaving a message effectively saying "leave us alone" is NOT gonna fly. -

I would call your bank like I did yesterday and ask. They told me what I needed to do and they investigate the claim and if your are found to be correct they will give you your money back and give you a provisional credit until they find out.

I am just posting here to let you know that Brian Smith also ripped me off. ANd I read through the entire thread, but no one mentioned this.
Brian's mother and girlfriend both informed me that Brian is IN JAIL.
Yep, Brian Smith is incarcerated right now, for driving without a license.

Do you guys think that those of us who have recieved a working clevo from Brian should be worried or get involved? I mean, I have my notebook and all. I did not pay for the "flawless 3 yr warranty" although I am supposed to have that warranty. So do I still have a one year warranty with Sager then?
It doesn't seem like it would make since to try and send back my clevo to try and get a refund, only to turn around and buy the same exact system from a more reputable reseller. -

Before we all thought that Brian is the best or at least one of them.
Now everyone, even who didnt have any trouble, says that he is a scamer, lamer and so on.
I DONT feel from my side i can say that UNTIL the situation wont be DEFINETLY CLEAR.
I had perfect relationship with Brian and he really treated me flawlessy.
No matter what i am reading around he will be for me a MITO.
At the same time i say to everybody...try to reach him...in any way.
Only he can say what really happened and what will happen.
I cant believe he leaved everything unsolved.
Coz i was more than one time in touch with him...he provided for me more than one item..he never asked to me to put some review for money and at the same time he cared about my requests.
So guys lets go stright and see what you can do.
And i really hope for you that Brian will come back here or there and say something interesting for all of you.

Yea i got my laptop from Brian too. And i payed for a warranty of three years because i did not know this company was being ran by a 22 year old that still living at home and has other projects that are more important than his "computer company" If i had known any of this i would have never bought from brian and probably neither would you. -
Since the first moment i have been in touch with Brian and did live talk to him i knew everything. That he was 22 years old, that he had a fiance with a child and that he was managing other 2 business but not more important than flawless. He putted all his efforts to Flawless.To improve the management of that company.
I knew everything and i trusted him.I didnt mistake because hee took his words.
He made for me a flawless system, he purchased for me things in Usa that i wouldnt find here in Italy and sent me here.We both found very good deal for my needs. He cared a lot of it even after i had my system at home.
So if he now encountered or is facing some trouble, maybe big, I dont think that YELLING against him will solve something.
Someone said that lives near his Home or Parents Home.
Well lets try to reach him directly.He isnt a fantom...is a real person with its pro and cons.
Brian if you are reading all of that say something.Bad or good so that people will understand..

The ram, hdd and cpu aren't covered, you have to contact corsair, hitachi, intel if those break.
i checked newegg and all notebook harddrives have a 1 year manufacturer warranty, corsair is lifetime, and intel is 3 years, don't know if brian got the parts through newegg though
if you got a refund and bought the same laptop from another company, you'd have to pay more money. You'd have to pay an additional $250+ for a 3 year warranty and you'd have to pay ~$200 more for parts. Brian really gave us a sweet deal on parts. I don't know if $450+ is worth it for a 3 year warranty and you don't have the guarantee your laptop will work 100% when it arrives. Plus you have to factor in the down time and the hassle to get your money back.
I just hope i don't have too many problems in the next 3 years. Although winter.raven's mobo problem doesn't make me too thrilled. Is there an update on this? It's been 5 days. -
No update from me rickster. Dont know why the mobo crashed....but it looks like I am the only one so dont worry guys!
I am going to call the house in a few days....
If I dont hear some definitive word from Brian or his family I will be talking with the local police guy over there. When I get back if I dont get my laptop I will make sure I have a flight layover in Denver and I will make a personal unhappy appearance. Im in Iraq and I cant deal with this right now.
I hope all is well with him, I understand trouble....god I understand trouble...lol. Infact this same thing happened to me (ran a computer business that ran to deep and I lost it all)...so I have faith that Brian will pull through. It took me 2 years but I finally did.... -

Around all the threads surrounding this on all sites u get alot of people who just assume were all war mongers wanting death and destruction.
Some people just don't seem to understand its ok that some of us are pissed off.
Just because were mad dont mean we want a bad outcome.
Most of us are at the stand point of waiting to see if he pulls a cinderella story? or goes out swordfish style?
me personally yeah ill admit i'm pretty pissed about my money. But, i also find it sad and hopefully he is a legit guy. because you get sick of seeing all the giants taking everything and corrupt little guys ruining it for the good ones out there.
But, if he gets out of jail or whatever. This is his chance, chance to make a true name for flawless if u ask me. If he can come threw on this and settle the problems. He will more then likely earn a respectiful name among the notebook community. So in a sense depending on the outcome can be a good thing for some people in this.

I have done some bankruptcy law before, it was one of the most depressing moments of my life.
Seeing people (like us) putting their life savings and efforts into a business and having it go bankrupt. The people all just wanted to get financial independence.. the American Dream... but its something that makes great stories when you get successful.
I do not feel that lawsuits are in order unless if a company refuses to refund the money paid or refuses to do what they promised. True that this incident was pretty abrupt but you must realize that the legal work behind a bankruptcy will take a little time. I know that if I put myself out there as an entrepreneur and fail, getting lawsuits would give me a negative sign for a future attempt.

UPDATE!
I just talked to the police detective, and he is sure that NO CRIMES have been committed. The business went down and he ran into some trouble, as of right now Brain has filled over 50% of his outstanding orders and is continuing to rectify the situation. YAY TO EVERYONE! -
