Personally I'd get an estimate on repairing it correctly or to repair the shoddy workmanship, then take them to small claims court.

NVIDIA is paying for the repair, so I'm surprised that Dell would shortchange you (HP would be another story...). Of course the settlement agreement does state, "Neither NVIDIA nor the OEMs make any representation, warranty or guarantee that any Chip Replacement will eliminate any malfunction or symptom." This whole settlement is a giant sham - from HP owners getting a POS to other OEMs not actually fixing the problem.

I am starting to understand why Apple computers are rated so high
by their customers. my daughter had a new DV9000 that she bought
from compusa, I guess they took a dump, so I did the hair dryer fix and
she gave it to her mother <myX> and as far as she knows it is still working.
So she bought a MacBookPro and loves it. There is no cooling fan in it that I
can see or hear and it seems like the bottom is the heat sink.

My best understanding is that there were laptops, manufactured by Apple, that contained the bad nVidia components.
Apple stonewalled their customers just like HP and Dell did.
When the bad components became recognized, all laptops containing them should have been recalled . . . and replaced with a new laptop not containing a bad GPU.

Your are right. Apple did the same. Apple made the free GPU repair but people complained that they started experiencing the same problems again.
Due to the nature of laptop design (parts exclusive to each model, which I hate btw) the only thing that is fair and right was to replace the whole laptop. -

I just got off the phone with one of their reps. He said that it may take 14 weeks. I told him that as of yesterday, they have had my computer for 13 weeks, so does that mean you will be sending it next week??? He said he could not commit to that, and that he only knows what Nvidia tells him. I asked if any computers have been sent out yet, and he said no. No computers have been sent out.

Has windows 7 Starter, 1gig ram, dual core cpu, 1 year factory warranty.
For what it is it runs pretty good, it seems fairly snapy so far. I am going to upgrade it to 2gig ram and to windows 7 premium.
I also kept my disc drive from my tx1000 (i taped the door cover back on the tx1000, so they must not of niticed
) Does anyone know any good enclosers i can use for for it, thanks.

Been following this thread off and on since the settlement debacle started. Sadly, you all got so screwed.
Sure I can say I will never buy anything nVidia, Dell, HP/Compaq, or Apple but the fact is that, today and in the future, I'll buy what is quality regardless of brand or rocky history. However, there is 1 thing I learned and will absolutely adhere to from now on:
ALWAYS OPT-OUT FROM CLASS ACTION LAWSUITS. NO EXCEPTIONS!
Lawyers are F UCKING CROOKS and so are the "incompetent" judges making absurd rulings. Consumers are the ones who get boned. -
Hi Lunar Aura. I agree with most of your comments. Good advice on opting out of class actions.
How the OEM handles any situation like this one speaks volumes about the OEM. For example, Dell was taking care of many, if not most, customers with the NVIDIA defect while this class action was ongoing. I started out with Dell's flagship über-expensive gaming beast XPS M1730, (which had defective NVIDIA components and was on the affected model list,) and ultimately ended up with my current Alienware as a warranty replacement. Dell has treated me very fairly and has won my loyalty through their superior service and fair treatment. In contrast, HP has stonewalled most customers all along and refused to help most of them, denied a problem existed, refused to accept any responsibility for selling a defective product, etc.
There are a whole bunch of us that are done with HP based on their nonchalant attitude, crummy service and the underhanded manner is which they treated their customers that purchased products with the defect relating to this class action. In my case, the disenchantment with HP started a few years prior to owning the machine relating to this class action, so they have a track record or poor service with me. Thankfully, I cannot speak from experience with crApple products, as I have zero interest in their products and never will.
Building you own desktop has always been a better option in my book, but DIY options are limited when it comes to notebooks. Things can go wrong with defective hardware components with any brand of computer. Painting Dell, HP and Apple with the same brush in the context of this situation is not fair and objective.
The above quoted part of your comments has me a little confused. I'm not sure how to interpret the statement that you will "never buy anything nVidia, Dell, HP/Compaq, or Apple" with " I'll buy what is quality regardless of brand or rocky history." Those two comments almost seem contradictory. Can you elaborate on what your thoughts are for clarity? -

Look at what happened to GM, I sure never expected them to fall below the gutter and into the sewer, so sometimes it comes back to bite them, but the customer always get screwed.

Doesn't really matter to me, I sent my F572US to them this week and as soon as I get the craptacular CQ56 it's going on craigslist, unopened. Figure I might get $250-275 for it at least. I have seen them on sale at Fry's for $279 from time to time, but those have the Celeron 900 CPU.

The model we're receiving retails at Best Buy for $279, so I wouldn't expect to get much over $200 on Craigslist. Good luck though.

So far it runs just as good as my old tx1000 if not a little better. I don't push my computers very hard throuth. -
have you tried multitasking with it yet? ie like watching youtube or netflix and doing a virus scan or video converting? I'm a heavy multitasker. a bit a ADHD in the blood. not that we would expect much but i'm interested in know how it fairs. oh wait you got the ASUS. i was thinking of the Comcrap.

Does youtube fine. Don't have virus protection yet. I used webroot on the tx1000 and it would kill my performance whenever i ran a scan and used to take around 3 hours to finish

Youtube has HD and non-HD. It may be interesting to some whether the dual-core upgrade works better with HD videos. The originally proposed ASUS was a single-core(N450) and reportedly was really bad at playing HD videos. But the dual-core(N570) is at the same clock frequency so it may or may not be much better..---the question is whether youtube can take advantage of dual-cores.

I'm very curious, too. If I receive the CQ56 I will do some benchmarks and let you know. It has been 10 weeks since the approval date.. I have to decide whether it is necessary to upgrade the CPU or not.

My point was more about time . . . the passage of time.
Whatever the CQ56 is worth today, it will be worth less this coming fall. By then it might make more sense just to upgrade the darn thing to dual core . . . if possible.
I did a small amount of shopping. Went to Staples, BB, and to Wal-Mart this past week. Was only able to find a CQ56 at BB. If they ever sold it to begin with, the CQ56 is no longer being sold at the other stores. Probably should also have checked the Shack. Not sure they would bother with something so "low end", though.
Anyway, I can't live with a single core. So something will have to be done.
One last thing:
The unit I saw at BB was on and running. I felt it top and bottom, checking for heat. Not bad. Now of course it was just sitting there doing nothing. With a game running the outcome might have been completely different. -
You know, with Best Buy having the same computer (CQ56-115dx) in stock, wouldn't it just make sense for HP/Milberg to issue store vouchers, instead of making everyone wait an additional 10-14 weeks?

I just watched a short 1080p video off of youtube on it. The asus has the eee super hyper engine(not joking, thats what they call it) witch controls the cpu output. At first i watched the video on high performance and it was choppy, them i watched it on super performance and it ok(a little choppy but not that noticable). The video did take a long time to load though so i won't be watching too much HD on it.

i am in somewhat unique situation,
actually my cousin.
he was in usa and that time he bought this affected nvidia based hp pavillion 2700 cto .
now its 2 yrs out of warrenty and he has dead notebook with him.
he has shifted to india so luck of any class suite benefits i guess,
how do i source replacement motherboard for this laptop.
i managed to take out motherboard and now hunting the replacement motherboard.
where should i look for it? -
There is no replacement motherboard that's not defective. that's why replacement computers are sent out. It's a bad design on the motherboard plus the faulty chips.

i'm thinking remove the keyboard entirely and replace with a large copper sheet welded to the heatsink and a small external blower pushing some air
thru tubes pointed above and below the gpu and thru the heat pipes. -
